Preamble |
This document is a Rental Agreement (“Agreement“) between “CUSTOMER NAME HERE” (the “Lessee”) and Texas Pro Trailers LLC (the “Lessor”).
This Rental Agreement and the Terms and Conditions form the entire “Agreement” between the Parties for the use of the Equipment and Services.

Start date, term, minimum commitment |
The Agreement commences on FILL IN START DATE & TIME, the “Rental Agreement Start Date & Time”. Unless duly terminated by the Client, the Rental Agreement will automatically begin at the Rental Agreement Start Date & Time. The Client agrees to a “Minimum Commitment” of “Days” until the “End of the Rental Agreement Term”, FILL IN END DATE & TIME.
For the avoidance of doubt in this Agreement:
The Contract Start Date is: FILL IN START DATE & TIME
The Term is: # of Days
The End of the Initial Term is: FILL IN END DATE & TIME

Rental Equipment & Rates |
The Lessor agrees to rent to the Lessee, and the Lessee agrees to rent from the Lessor, the following described trailer(s) (the “Trailer(s)”):
The Lessee agrees to the rental rate shall be for the above listed trailer(s) is $________ per day/week/month. For all rentals a $45 booking/reservation fee will paid upfront (Booking Fee will be applied to overall rental cost). The total rental amount due for the Rental Period is $________, payable in advance.

Security Deposit |
The Lessee shall pay a security deposit of $200 (USD) at the time of signing this Agreement. The security deposit is refundable upon the return of the Trailer(s) in the same condition as received.

Payment Terms |
The total payment of $_______ shall be made with a valid Debit/Credit card at the time of signing this Agreement. Any additional charges incurred during the rental period shall be paid by the Lessee upon return of the Trailer(s).

Use of Trailer(s) & Equipment |
The Lessee agrees to use the Trailer(s) and Equipment only for lawful purposes and in a careful and proper manner. The Trailer(s) shall not be used for:
– Transporting hazardous materials.
– Any illegal activities.
– Exceeding the weight limit of __________ pounds.
The Lessee shall not sublease, rent, or transfer the trailer(s) to any other party under any circumstance. The Lessee must always remain in control of the trailer(s) and equipment during the rental period.

Maintenance & Repairs |
The Lessee agrees to maintain the Trailer(s) in good condition and to perform routine maintenance as necessary. Any required repairs must be reported to the Lessor immediately. The Lessee shall be fully responsible for the cost of repairs resulting from misuse, negligence, or accidents.

Drivers License & Insurance |
The Lessee agrees to maintain a valid driver’s license and auto insurance coverage for the durations of the Rental Period. Proof of a valid drive’s license and insurance must be provided to the Lessor upon the start of the Rental Agreement.
In the State of Texas, Trailer Insurance is not required, and standard Auto Insurance will and should cover the trailer during use. Therefore, should any damage to the trailer(s) occur, the Lessee agrees that the Lessee’s auto policy and the Lessee themselves be responsible for the cost of repairs.
Furthermore, should the Lessee’s auto policy not cover trailers or the use of the trailers, the Lessee agrees to assume the responsibility of any costs for damage that incur during the rental period.
All Lessee’s must be 18 years of age or older to enter a Rental Agreement with Texas Pro Trailers LLC.

Indemnification & Liability |
The Lessee agrees to indemnify and hold harmless the Lessor from any and all claims, liabilities, damages, or expenses arising from the Lessee’s use of the Trailer(s) or equipment.
The Lessee assumes all risks and liability for the trailer during the rental period.
The Lessor is not responsible for any loss, damage, injury, or claims resulting from the use of the trailer.
The Lessor is not responsible for any damages to any or all items that will, are, or have been transported by the rental trailer or with the rental equipment.

Return of Trailer(s) and Equipment |
The Lessee agrees to return the Trailer(s) and equipment to the Lessor at ________________________ (location) by ___/___/20__ (time). The Trailer(s) and equipment must be returned in the same condition as received.
Should the Lessee fail to return the trailer(s) the Lessor reserves the right to repossess the trailer immediately following the end of the rental period. If the Lessee is 15 minutes late to the agree drop off time, a $20 late fee will be applied. For every 30 minutes after that 15-minute period, an additional $30 charge will be applied. Should the Lessor be forced to retrieve the trailer(s) and rental equipment then a retrieval fee of $100 will be applied plus 0.55 cents for each mile the Lessor must drive from the original agreed drop off location to the location of the trailer(s) and rental equipment (this retrieval fee will be applied to each trailer(s)).
Should the trailer(s) or equipment be damaged or in need of repair the Lessor reserves the right to withhold the security deposit as well as charge the Lessee the costs of replacement, damage, or repairs that are needed for the trailer(s) or equipment. Such costs will be no more than fair equal value to the trailer(s) or equipment themselves or the repairs necessary.

Termination |
The Lessor reserves the right to terminate this Agreement immediately upon any breach by the Lessee of the terms and conditions herein. The Lessee may terminate this Agreement by returning the Trailer(s) and equipment at any time.
The Lessee may terminate this Agreement and receive a full refund so long a 24-hour notice was given to the Lessor. If the Lessee fails to cancel the Rental Agreement prior to the 24-hour notice, then the booking/reservation fee will be kept by the Lessor to cover the cost of cancelation.
Should the Lessee return the trailer(s) and equipment to the Lessor prior to end of the Rental Agreement (returned “early”) no refund other than the security deposit will be returned.

Governing Law |
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas.
|
Entire Agreement |
This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements, whether written or oral.
